Fair Housing Statement
Openhouso is committed to the letter and spirit of the Fair Housing Act. All real estate advertised on this platform is subject to the Federal Fair Housing Act (42 U.S.C. §§ 3601-3619), which makes it illegal to advertise any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin, or intention to make any such preference, limitation, or discrimination.
State and local laws may protect additional classes. We will not knowingly accept any advertising for real estate which is in violation of any applicable law. All persons are hereby informed that all dwellings advertised on this platform are available on an equal opportunity basis.

What Openhouso Is and Is Not
Openhouso is a technology platform that facilitates connections between licensed real estate agents for open house coverage. Openhouso:
- Is not a real estate brokerage and does not hold a real estate license in any state
- Does not provide real estate services, advice, or representation to any party
- Does not employ, supervise, or control any real estate agent using the Platform
- Does not participate in real estate transactions, negotiations, or commission splits
- Does not guarantee the accuracy of property listings, agent credentials, or vendor information
- Is not a party to any agreement between listing agents and host agents
Agent Licensing Requirements
All agents using Openhouso must hold a valid, active real estate license in the state where they practice. Agents are solely responsible for:
- Maintaining an active license with their state's real estate commission or department
- Operating under a licensed broker as required by their state
- Complying with their state's continuing education requirements
- Following their state's advertising and disclosure regulations
- Ensuring their broker approves of their participation in open house coverage arrangements
- Complying with their MLS rules and regulations
Openhouso does not verify agent licenses. If you suspect an agent is operating without a valid license, contact your state's real estate regulatory authority.
NAR Settlement Practice Changes (August 2024)
The National Association of Realtors settlement, effective August 17, 2024, introduced significant changes to real estate practices nationwide:
- Buyer-broker agreements: Buyers must sign a written representation agreement with an agent before touring homes. However, open houses are currently exempt from this requirement — buyers may attend open houses without a signed agreement.
- Commission transparency: Listing agents may no longer make blanket offers of compensation to buyer agents through the MLS. Compensation is negotiated directly between parties.
- Host agent disclosure: When hosting an open house, the agent represents the seller. This must be disclosed to all visitors. Openhouso's QR sign-in form includes this disclosure: "I understand the host agent at this open house represents the seller."
Agents are responsible for staying current on NAR, MLS, and state-specific rules as they continue to evolve. These rules may vary by MLS and state association.
Open House Sign-In Disclosure
When buyers sign in at an open house via Openhouso's QR code, the following disclosures are presented on the sign-in form:
- "I understand the host agent at this open house represents the seller." — Buyers must acknowledge this before submitting.
- Buyer name, phone, and email are collected for the purpose of open house visitor tracking, lead follow-up by the host agent, and seller reporting to the listing agent.
- Vendor opt-in checkboxes are never pre-checked. Buyer data is shared with a vendor only upon explicit consumer consent.
RESPA Disclosure (Vendors)
The Real Estate Settlement Procedures Act (RESPA) prohibits kickbacks and unearned referral fees in real estate transactions. Openhouso's vendor sponsorship model is an advertising arrangement, not a referral fee arrangement:
- Vendors pay for advertising placement and brand visibility — not for referrals
- Agents are never compensated for recommending a specific vendor to a buyer
- Buyer opt-in leads are the result of consumer choice, not agent steering
- Vendor sponsorship tiers determine advertising placement, not preferential treatment in transactions
Vendors are responsible for ensuring their participation complies with RESPA, TILA, and applicable state regulations governing their industry.
Consumer Data Rights
Openhouso honors consumer privacy rights under all applicable state and federal laws, including but not limited to:
- CCPA/CPRA (California): Right to know, right to delete, right to opt out of sale (we do not sell data), right to non-discrimination
- CPA (Colorado), CTDPA (Connecticut), VCDPA (Virginia), UCPA (Utah): Right to access, correct, delete, and opt out of targeted advertising
- TDPSA (Texas), TIPA (Tennessee), ICDPA (Iowa), MODPA (Montana), OCDPA (Oregon), INDPA (Indiana): Right to access, delete, and opt out of data sales
- CAN-SPAM Act: All marketing emails include an unsubscribe link and are sent only with consent
- TCPA (Telephone Consumer Protection Act): SMS notifications are sent only to agents who provided their phone number during registration. Buyers are not enrolled in any SMS marketing.

Dispute Resolution
Openhouso does not mediate disputes between agents, between agents and buyers, or between agents and vendors. Disputes regarding real estate transactions, commission splits, referral agreements, or professional conduct should be directed to the parties' respective brokers, state real estate commissions, or local REALTOR® associations.
