1. Acceptance of Terms
By accessing or using Openhouso ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. Openhouso is operated by Openhouso LLC ("we," "us," "our").
2. Eligibility
You must hold an active real estate license in your state of practice to create an account and use the Platform's agent features. You represent that all information you provide during registration is accurate and current. Buyer sign-in features at open houses are available to the general public and do not require an account.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Platform Services
Openhouso provides a marketplace connecting listing agents who need open house coverage with host agents who wish to host open houses. The Platform facilitates the posting of open houses, claiming of coverage assignments, buyer sign-in at events, lead notifications, and seller reporting. Openhouso does not employ, supervise, or control any agent's conduct at an open house.
5. Open House Listings and Claims
Listing agents may post open houses with accurate property details. Host agents may claim available open houses. Once claimed, the host agent agrees to appear at the property during the scheduled time. No-shows may result in negative ratings and potential account restrictions. The listing agent remains the procuring agent for the property; the host agent operates under the coverage model selected (open opportunity or referral-back).
6. Lead Data and Privacy
Buyer sign-in data collected at open houses is shared only with the host agent for that event and the listing agent who posted the open house. You agree not to sell, distribute, or share buyer personal information collected through Openhouso with any third party not involved in the specific transaction, except as required by law. 7. Referral Agreements
When a listing agent selects the "referral-back" coverage model, the specified referral percentage applies to any buy-side commission earned by the host agent from leads generated at that specific open house. Referral agreements are between the listing agent and host agent directly. Openhouso does not enforce, mediate, or guarantee referral payments.
8. Prohibited Conduct
You may not: (a) use the Platform for any unlawful purpose; (b) submit false or misleading property information; (c) impersonate another agent or entity; (d) harvest or scrape buyer data from the Platform; (e) attempt to circumvent security features; (f) post spam or solicitations unrelated to open house coverage.
9. Limitation of Liability
Openhouso is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Platform, including but not limited to lost leads, missed open houses, referral disputes, or data breaches beyond our reasonable control. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (which may be $0 for free-tier users).
10. Indemnification
You agree to indemnify and hold harmless Openhouso, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your conduct at any open house facilitated through the Platform.
11. Modifications
We may update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Hillsborough County, Florida.
